5/22/6 Songwriters Capital Gains Tax Equity Act Passes
Greg Seneff reports that the Songwriters Capital Gains Tax Equity Act passed both the U.S. House of Representatives and the U.S. Senate as part of the Tax Reconciliation Act of 2005. The new legislation was signed into law on May 17, 2006. This legislation gives individual songwriters the same capital gains opportunities currently enjoyed by all other property owners. When the Songwriters Capital Gains Tax Equity Act takes effect on January 1, 2007, a songwriter who sells the rights to his/her song catalog will pay a 15% tax to the government on the sale of that catalog rather than 40% in taxes which was previously assessed. Music publishers may now amortize investments they make in music creators.

On behalf of the GMA, CMPA, and CMTA, John Styll said, “Our organizations are supportive of the reforms proposed by Senators Feinstein, Graham, and Majority Leader Frist because they update the law in order to extend protections for music rights-holders in this new digital environment.”
